1. About these terms
These Terms of Use ("Terms") govern your access to and use of the Maisonflex website, mobile applications, simulators, calculators, customer dashboard and any related digital services (together, the "Platform"). By accessing the Platform you confirm that you have read, understood and accepted these Terms.
These Terms apply to the use of the Platform itself. They do not constitute, and must not be read as, the contractual terms of any financial product. Any financial product made available through the Platform is governed exclusively by the separate pre-contractual information, product terms and agreement signed between you and the relevant Local Entity.
2. Who we are
"Maisonflex", "we", "us" or "our" means Maisonflex Group and, where the context refers to the entity that contracts with you or processes your application, the relevant Local Entity established in your country of residence (each a Local Entity). The Local Entity that will contract with you, where applicable, is identified in your customer dashboard, in your pre-contractual information and on any product agreement.
Examples of Local Entities (non-exhaustive, subject to authorisation): Maisonflex España, S.A. · Maisonflex France SAS · Maisonflex Deutschland GmbH · Maisonflex Italia S.p.A. · Maisonflex Portugal, S.A.
3. Regulatory status (important)
Maisonflex is currently in the process of seeking authorisation in the jurisdictions in which it intends to operate. The relevant Local Entity intends to operate under the supervision of the competent national authority in its country of establishment (for example, Banco de España in Spain, the ACPR in France, BaFin in Germany, Banca d'Italia in Italy, Banco de Portugal in Portugal).
Until the relevant authorisation has been granted in writing and any applicable EU passporting notifications are complete:
- Maisonflex is not authorised as a credit institution, payment institution, electronic money institution or investment firm in any EU/EEA jurisdiction;
- No binding offer of any regulated financial product will be made to consumers in any country;
- Content on the Platform describing products, indicative rates, eligibility or process is provided for informational purposes only and does not constitute a personal recommendation, financial advice, an offer or a solicitation.
4. Eligibility
You may use the Platform only if you are:
- at least 18 years old (or the age of majority in your country of residence, if higher);
- legally capable of entering into binding contracts;
- resident in a country in which Maisonflex makes the Platform available; and
- not subject to any sanctions or restrictions that would prohibit Maisonflex from providing services to you.
5. Your account
Some areas of the Platform require an account. You agree to provide accurate, current and complete information; keep your credentials confidential; notify us immediately at [CONTACT EMAIL] of any unauthorised access; and accept responsibility for all activity carried out under your account. We may verify your identity at any time, including by carrying out customer due diligence ("KYC") and anti-money-laundering ("AML") checks where required by law.
6. Use of simulators, calculators and indicative figures
The Platform may include simulators, calculators, illustrative cash-flow projections and indicative pricing tools. All such outputs are indicative estimates based on the inputs you provide and on assumptions selected by Maisonflex. They do not constitute an offer, a binding quotation, financial advice or a personal recommendation, and may differ materially from the terms of any actual product that may later be offered following full underwriting, valuation and regulatory checks.
7. Acceptable use
You agree not to:
- use the Platform for any unlawful, fraudulent or harmful purpose;
- submit false, misleading or third-party information without authority;
- attempt to gain unauthorised access to the Platform, other users' accounts, or any underlying systems;
- introduce malware, conduct denial-of-service attacks, scrape content at volume, or interfere with the integrity or performance of the Platform;
- reverse-engineer, decompile or extract source code, models or proprietary logic, except to the extent expressly permitted by mandatory law;
- use the Platform to build a competing product or to train machine-learning models without our prior written consent.
8. Intellectual property
All content, design, software, trademarks, logos and other materials available on the Platform are owned by Maisonflex or its licensors and are protected by copyright, trademark, database and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes only.
9. Third-party content and links
The Platform may contain links to, or content from, third parties (for example regulators, statistical agencies, valuation providers or news sources). Maisonflex does not control and is not responsible for third-party content, and the inclusion of any link is not an endorsement.
10. Availability and changes
We aim to make the Platform available on a continuous basis but do not guarantee uninterrupted access. We may modify, suspend or discontinue any feature at any time, and carry out maintenance, security or compliance work that temporarily limits access.
11. Disclaimers
To the maximum extent permitted by applicable law, the Platform and its content are provided "as is" and "as available", without warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. Nothing in these Terms excludes or limits any liability that cannot be excluded under mandatory consumer-protection law in your country of residence.
12. Limitation of liability
Subject to Section 11, Maisonflex's aggregate liability arising out of or in connection with your use of the Platform shall not exceed EUR 100, except in cases of fraud, wilful misconduct or gross negligence, or where mandatory law prevents such limitation. Maisonflex shall not be liable for indirect, incidental, special or consequential losses, including loss of profits, loss of opportunity, or losses arising from your reliance on indicative tools, simulators or informational content.
13. Complaints and out-of-court redress
If you have a complaint about the Platform, please contact us first at [COMPLAINTS EMAIL]. We will acknowledge your complaint promptly and provide a substantive response within the timeframe required by the law applicable to the relevant Local Entity. If you are not satisfied with our final response, you may be entitled to refer your complaint to the competent alternative dispute resolution ("ADR") body or financial ombudsman in your country of residence. 14. Changes to these terms
We may update these Terms from time to time. The current version is always available on the Platform with a clearly displayed effective date. Material changes will be notified to account-holders by email or in-app message at least 30 days before they take effect, unless a shorter period is required by law.
15. Governing law and jurisdiction
These Terms are governed by the laws of [GOVERNING LAW COUNTRY] (being the country of establishment of the relevant Local Entity), without prejudice to mandatory consumer-protection rules of your country of residence. Any dispute shall be submitted to the competent [COURTS], without prejudice to your right to bring proceedings in the courts of your country of residence where mandatory law so allows.
